Today, On 25th July, The Delhi High Court instructed the Delhi Development Authority (DDA) to fence the Yamuna floodplain after removing all encroachments. This directive aims to protect the area and prevent further illegal activities.

New Delhi: The Delhi High Court, On Thursday, directed the Delhi Development Authority (DDA) to fence off the Yamuna river‘s floodplain following the removal of encroachments, ensuring no future illegal constructions in the area.

A division bench, including Acting Chief Justice Manmohan and Justice Tushar Rao Gedela, addressing a public interest litigation (PIL) filed by SD Windlesh. The petition sought the demolition of a dargah and kabristan located in the Yamuna floodplains area.

The directive came from a bench led by Acting Chief Justice Manmohan, who previously ordered the clearance of all encroachments and illegal structures along the riverbank.

This order issued while the court was addressing a petition that sought the demolition of an allegedly unauthorized dargah and graveyard situated near the Signature Bridge.

The court instructed the DDA to review the petitioner’s concerns regarding the supposed encroachment within a six-week timeframe. However, it declined the request to form and deploy a special task force specifically for addressing illegal constructions on the river’s floodplain.

The court emphasized the need for authorities to leverage technology to monitor any new illegal constructions instead of relying on a special force.

The bench, which also included Justice Tushar Rao Gedela, stated,

“A special force will lead to further corruption. They need to be more vigilant and use technology.”

The court further instructed the Vice Chairman of the DDA to ensure that, following the removal of encroachments, the Yamuna floodplain area is protected and properly fenced to prevent any future encroachments.

Previously, on July 8, while addressing another petition concerning alleged illegal construction near Shaheen Bagh, the high court directed the DDA vice-chairman to remove all encroachments and illegal constructions on the Yamuna river bank, its riverbed, and the drains flowing into the river.

On April 8, in response to a suo-motu case addressing the issue of waterlogging in Delhi during the monsoon season, the high court ordered the removal of encroachments from the Yamuna floodplains and requested a report from the DDA on the development of biodiversity parks and wetlands in the area.

The court highlighted the necessity of green development along the riverbanks and issued directives for the rejuvenation of the river, including the removal of construction debris and the implementation of “controlled and scientific dredging” by the DDA on an urgent basis.
