Allahabad: The Allahabad High Court has announced a major change in the roster of Justice Shekhar Kumar Yadav,, who recently drew criticism for controversial remarks targeting the Muslim community during an event organized by the legal wing of the Vishwa Hindu Parishad (VHP).
Effective December 16, Justice Yadav will only handle first appeals related to district court orders, restricted to cases filed up to 2010. This marks a departure from his prior roster, which included sensitive bail matters concerning rape cases since October 15.
The roster change follows the Supreme Court’s decision to seek a report from the High Court regarding Justice Yadav’s remarks made on December 8.
During his speech, he asserted that India would operate according to the wishes of the majority community, used a derogatory term against Muslims, and expressed confidence in the enactment of a Uniform Civil Code.
“I have no hesitation in saying that this is Hindustan, and this country will function according to the majority living here. This is the law. It is not about speaking as a High Court Judge; the law follows the majority,” Justice Yadav said. He likened the situation to a family or society, where only the welfare of the majority will be accepted.
His speech also included derogatory remarks, including the term “kathmullah” to describe extremists, suggesting the country should remain cautious about them.

The remarks sparked widespread calls for action against Justice Yadav. The Campaign for Judicial Accountability and Reforms (CJAR) lodged a formal complaint with the Chief Justice of India (CJI) on December 10, demanding an in-house inquiry.
Parliamentarian Ruhullah Mehdi and Senior Advocate Kapil Sibal have also called for his impeachment, with Sibal announcing plans to introduce a motion in Parliament.
Chief Justice Arun Bhansali has reassigned Justice Yadav’s previous matters. Bail applications in rape cases will now be heard by Justice Sanjay Kumar Singh, while criminal revisions under the Juvenile Justice Act, earlier handled by Justice Yadav, have been transferred to Justice Samit Gupta. Justice Kshitij Shailendra, who previously handled first appeals filed after 2011, will continue with those cases and additional matters on his roster.
Justice Yadav, appointed in 2019, has predominantly held criminal rosters, including bail applications and anticipatory bail matters under Section 482 of the Code of Criminal Procedure (CrPC). He managed similar rosters through 2022 and 2023, until the recent changes prompted by his controversial speech.
