Terror Funding Case || “Decide Engineer Rashid’s Bail Plea Expeditiously”: Delhi HC to NIA Court

Today, On 24th February, The Delhi High Court urged the NIA court to quickly decide the bail plea of Abdul Rashid Sheikh, also known as Engineer Rashid, a jailed MP from Jammu and Kashmir. He is facing charges in a terror funding case. Justice Vikas Mahajan requested the Patiala House Court to handle the matter without delay.

New Delhi: Delhi High Court urged the court handling cases for the National Investigation Agency (NIA) to promptly decide the bail plea of Abdul Rashid Sheikh, also known as Engineer Rashid, a jailed Member of Parliament from Jammu and Kashmir, in a terror funding case.

Justice Vikas Mahajan stated,

“The ASJ-03, Patiala House Court is requested to dispose of the bail application of the petitioner expeditiously.”

The court was addressing Rashid’s plea, which claimed that there was no remedy available after the NIA court left him in a state of uncertainty following his election as a Member of Parliament.

Justice Mahajan noted that a direction had been issued by the high court on the administrative side clarifying that the NIA court would continue to hear the case. In light of this development, Rashid’s lawyer sought to withdraw the plea from the high court.

The Baramulla MP is currently on trial for allegations of funding separatists and terror groups in Jammu and Kashmir.

He was elected from the Baramulla constituency in the 2024 Lok Sabha elections and has been detained in Tihar Jail since 2019, following his arrest by the NIA under the Unlawful Activities (Prevention) Act in connection with a 2017 terror-funding case.

The Jammu and Kashmir Assembly elections, comprising 90 seats, were conducted in three phases between September 18 and October 1, with the National Conference-Congress alliance winning 48 seats, as announced on October 8.

Previously, Rashid granted a two-day custody parole to attend the ongoing Parliament session on February 11 and 13 as interim relief.
