NEW DELHI: The Delhi High Court on Friday clarified that its earlier order in the Sunjay Kapur estate dispute would be rectified to the extent that it had wrongly recorded the presence of lawyers on behalf of his sister, Mandhira Kapur. Justice Jyoti Singh allowed an application filed by Priya Kapur, Sunjay’s widow, objecting to Mandhira being reflected as a party to the case.

The issue arose when the court’s September 10 order, passed during the hearing of a plea filed by Karisma Kapoor’s children seeking a share in their father’s estate, not only directed Priya Kapur to disclose all movable and immovable assets of Sunjay Kapur but also noted the appearance of lawyers said to be representing Mandhira Kapur, despite her not being impleaded in the proceedings.

Priya Kapur, along with her minor son—the primary defendants in the suit—moved a rectification application, asserting that Mandhira’s counsel neither filed an impleadment application nor addressed the court during the hearing. The application described this as a “deliberate and mischievous attempt” to secure a backdoor entry into the case, stressing that the act was legally impermissible and amounted to an abuse of process intended to create a misleading record.

After hearing the parties, Justice Jyoti Singh accepted Priya’s objections and ordered that the record be corrected, removing any reference to Mandhira Kapur’s legal representation in the matter.

Earlier in the Delhi High Court

In the Delhi High Court, the dispute came up before Justice Jyoti Singh, who directed that the suit be formally registered after hearing both sides. The judge issued notices to Priya Kapur and allowed her two weeks to file a reply, while giving Sunjay Kapur’s children one additional week to submit their rejoinders.

She further ordered Priya Kapur to disclose a complete list of all movable and immovable assets of the late industrialist as of June 12, 2025. The court also required that the original will be produced in a sealed envelope for examination.

To balance confidentiality with the heirs’ right to inspect the document, Justice Singh suggested considering a non-disclosure arrangement similar to those commonly used in intellectual property matters.

Background

In a high-profile family dispute, the children of Bollywood actor Karisma Kapoor and late businessman Sunjay Kapur have approached the Delhi High Court seeking their share in their father’s estimated Rs 30,000 crore estate.

The children alleged that Priya Kapur, Sunjay Kapur’s third wife, had forged his will to claim complete control over the assets, leaving them unfairly excluded. The disputed will, dated 21 March 2025, reportedly bequeaths the entire estate solely to Priya Kapur.

The suit names Priya Kapur, her minor son, Sunjay Kapur’s mother Rani Kapur, and the executor of the will, Shradha Suri Marwah, as defendants. The children claim that Priya, along with associates Dinesh Agarwal and Nitin Sharma, concealed the will for over seven weeks and disclosed it only at a family meeting on 30 July 2025.

They have argued that the will is forged and fabricated, citing suspicious circumstances and refusal to provide them with a copy. Through their petition, the children seek:
