Don’t Upload Any Objectionable Post on Social Media: Allahabad HC Grants Bail To Man Over ‘Pakistan Zindabad’ Post

The Allahabad High Court granted bail to a man arrested last May for allegedly posting “Pakistan Zindabad” on Instagram after the Pahalgam attack. The court ordered, “The applicant will not upload any objectionable post on social media which is against the reputation of the country or against any community.”

The Allahabad High Court granted bail to a man arrested in May of the previous year for allegedly posting “Pakistan Zindabad” on his Instagram account in the wake of the Pahalgam attack.

While granting the relief, Justice Arun Singh Deshwal imposed a condition that the accused must refrain from posting any objectionable content online.

One of the bail conditions stated,

“The applicant will not upload any objectionable post on social media which is against the reputation of the country or against any community,”

The Court cautioned that violating any of the conditions would result in the cancellation of the bail. The accused had been charged by Etah police under several provisions of the Bharatiya Nyaya Sanhita, including the previous offense of sedition.

His lawyer argued that while the post may have been deemed objectionable, Section 152 of the BNS was not applicable since it did not contain any derogatory or disrespectful remarks about India.

The counsel asserted,

“Merely supporting an enemy country will not itself come under the purview of Section 152 BNS,”

Additionally, he noted that the accused had been incarcerated since May 3, 2025, and would not misuse his freedom if granted bail.

However, the State opposed the application.

After assessing the nature of the offense, the evidence, the accused’s involvement, as well as the overcrowded prison conditions and the significant backlog of cases before trial courts, the High Court decided to grant bail.

It ruled,

“Let the applicant Faizan, involved in the aforementioned crime be released on bail, on his furnishing a personal bond and two sureties each in the like amount, to the satisfaction of the court concerned,”

Senior Advocate NI Jafri, alongside Advocate Sadrul Islam Jafri, represented the accused, while Advocate Rakesh Kumar Mishra represented the State.
