BJP leader Shahnawaz Hussain received significant relief in his rape case as the Delhi High Court upheld the lower court’s decision. New Delhi: BJP leader Shahnawaz Hussain received significant relief from the Delhi High Court, which upheld the lower court’s decision to accept the police’s cancellation report regarding accusations of rape and criminal intimidation against him.
Justice Neena Bansal Krishna of the Delhi High Court stated that there were no errors in the order passed by the Additional Sessions Judge (ASJ). As a result, the complainant’s revision petition challenging the December 2023 order dismissed.

Justice Neena Bansal noted that the evidence and scientific findings collected during the investigation clearly showed that Hussain and the complainant were not present at the alleged time and place of the incident, rendering the possibility of the crime null. Therefore, the ASJ’s decision to accept the cancellation report justified. The High Court found no flaws in the December 16, 2023 order and dismissed the revision petition, issuing this ruling on Friday.
The complainant accused BJP leader Syed Shahnawaz Hussain of drugging and raping her at a Delhi farmhouse in April 2018. The police had filed a report in court seeking to quash the FIR.
The magistrate’s court initially rejected the police’s report and summoned Hussain. This decision was later challenged in a sessions court, which overturned the magistrate’s order and accepted the police’s cancellation report on December 16, 2023.

The complainant then took the matter to the High Court, filing a revision petition against the sessions court’s decision. The High Court noted that the ASJ relied on a thorough investigation conducted by the investigating officer, which found no evidence to support the rape allegations made by the complainant.
In 2018, a woman from Delhi sought to file an FIR against Hussain for alleged rape. However, the BJP leader consistently denied the accusation.
