Rajasthan High Court Denies Interim Bail to Asaram Bapu, Seeks Affidavit on Alleged Violation

Rajasthan: 2nd April: The Rajasthan High Court has denied interim bail to Asaram, who is currently serving a life sentence in a rape case. On Wednesday, the court directed his lawyer to submit an affidavit regarding allegations that Asaram violated Supreme Court conditions while on interim bail.

The victim’s lawyer strongly opposed any extension of Asaram’s interim bail. He argued that Asaram had previously violated court conditions and should not be granted further relief.

The bench, comprising Justice Dinesh Mehta and Vineet Kumar Mathur, directed him to submit an affidavit addressing these allegations.

The court has scheduled the next hearing for April 7 and asked Asaram’s legal team to submit a counter-affidavit regarding the alleged violation.

After his interim bail period ended, Asaram surrendered at Jodhpur Central Jail on April 1 at 1:30 PM. However, he remained there for only about 10 hours before being shifted to a private hospital named Arogyaam on Pali Road at 11:30 PM. No official reason has been provided for his hospitalization.

Previously, Asaram was granted three months of interim bail by the Gujarat High Court in connection with the Surat rape case. Despite securing bail in Gujarat, he cannot be released unless he receives relief in both cases.

Officials confirmed, “Until then, he will remain under custody.”

On Tuesday, after the Rajasthan High Court reopened, Asaram’s lawyer, Nishant Bora, requested an urgent hearing on his bail plea. The matter was heard on Wednesday.

The court specifically questioned Asaram’s lawyer about the alleged violation of Supreme Court conditions by giving sermons.

The Supreme Court had initially granted interim bail to Asaram on January 14 for medical treatment. This was later extended by the Rajasthan High Court until March 31. With this period now expired, Asaram’s legal team has filed a fresh petition seeking an extension.

Meanwhile, despite the Gujarat High Court granting Asaram three months of interim bail in the Surat rape case, he remains in custody due to the pending case in Rajasthan.

Details of Convictions and Sentences

Asaram has been convicted in two serious sexual assault cases, both resulting in life imprisonment:

  1. Jodhpur Case (2013): Arrested for raping a minor girl at his ashram. He was sentenced to life imprisonment.
  2. Gujarat Case (Surat): Accused of repeatedly sexually assaulting a woman at his Gandhinagar ashram. He was sentenced to life imprisonment in January 2023.
