NEW DELHI: The Delhi High Court today dismissed a petition seeking to annul Prime Minister Narendra Modi’s candidature from the Varanasi Lok Sabha constituency in the ongoing elections.

The plea, filed by Captain Deepak Kumar, a pilot, accused Modi of submitting a false oath and engaging in a conspiracy against him.

Justice Sachin Datta, who presided over the case, described the petition as ‘mala fide’ and thus rejected it. The court found no merit in the allegations, which included claims that Modi made a false affirmation of allegiance to the Indian Constitution.

The petitioner alleged,

“The candidate for Varanasi constituency for the 2024 general elections, Narendra Modi, had submitted before the returning officer a false oath or affirmation to bear true faith and allegiance to the Constitution of India.”

The plea further accused Modi of conspiring to crash a plane to assassinate Kumar, citing an incident involving Flight AI 459 on July 8, 2018.

“Modi and his accomplices are accused of screening the criminal conspiracy where the accused accomplices, Candidate Modi, attempted to destabilize national security by planning a fatal crash of Flight AI 459 of 08.07.2018,”

-the petition stated.

Kumar argued that this false oath should be thoroughly investigated and, if proven true, Modi should be barred from holding any public office.

The court’s dismissal of the petition reinforces the legitimacy of Modi’s candidacy and his adherence to constitutional protocols. The judgment also highlights the judiciary’s role in scrutinizing and resolving election-related disputes, ensuring that baseless claims do not hinder the democratic process.
