However, the court concluded that Patel had submitted forged documents, granting the NTA the right to pursue legal action against her.
The high court’s Lucknow bench had earlier directed the NTA to present the original OMR answer sheet of the student. Complying with this order, NTA’s Deputy Director Sandeep Sharma appeared before the court with the original documents and an affidavit. Upon review, the court found the student’s OMR sheet intact, contradicting Patel’s claims.
Ayushi Patel had previously petitioned, stating that the NTA had communicated to her that her result would not be declared due to the torn OMR sheet. She also posted a video on social media, which gained significant attention amidst ongoing concerns about irregularities in the NEET exam process.
In her petition, Patel demanded a manual evaluation of her OMR sheet, an inquiry against the NTA, and a halt to the admission counseling process. On June 12, a vacation bench of Justice Rajesh Singh requested the NTA to produce Patel’s original records. Following the presentation of these documents by the NTA, the court discovered that Patel’s petition was based on falsified documents.
The court expressed its regret and stated,
“The NTA is free to take legal action in the matter.”
During the proceedings, Patel’s advocate sought permission to withdraw the petition, which the court permitted. The NTA informed the court that they had already decided to take legal action against Patel for her fraudulent claims.
The court reiterated,
“The petitioner has submitted forged documents, and in such a situation this court cannot stop NTA from taking legal action against the student.”
Reacting to the controversy stirred by Patel’s video, which was shared by Congress leader Priyanka Gandhi and others, the NTA clarified on June 12,
“Her paper is still intact and it’s a case of forgery on the part of the candidate whose actual score is lower than claimed.”
An NTA official further emphasized,
“No torn OMR answer sheet was sent from any official NTA email, and the actual OMR is available and not torn. Moreover, all results are available online.”
The NTA countered the claims of an incorrect result on social media, stating,
“Regarding the viral video featuring Ms. XXX, claiming discrepancies in NEET (UG) 2024 scoring and receiving of a torn OMR answer sheet, NTA clarifies that no torn answer sheet was sent via an official NTA ID. OMR answer sheet is intact and scores are accurate as per official records…”
