The Madhya Pradesh High Court has rescheduled the hearing for the helmet case to February 19th. The case pertains to the mandatory use of helmets by two-wheeler riders
Bhopal/Jabalpur: A division bench of the MP High Court has extended the deadline for the state government to respond until February 19 regarding the measures devised to ensure adherence to traffic regulations. Aishwarya Shandilya, a law student, initiated a public interest litigation (PIL) at the Gwalior bench. The decision came during a hearing chaired by the state’s chief secretary.
The bench addressed a public interest litigation (PIL) advocating for stringent implementation of traffic laws, directing helmets for two-wheeler riders, seat belts for passengers, and the installation of High-Security Registration plates (HSRP) on vehicles. It was revealed during the court session that the state chief secretary had called for a meeting to strategize the enforcement of traffic laws.
The Motor Vehicles Act, 1988, includes provisions related to the use of helmets primarily to ensure the safety of two-wheeler riders. Here are the key points regarding helmets as per the Motor Vehicles Act. The Act mandates the use of helmets by riders of two-wheeler vehicles, including motorcycles, scooters, and mopeds, as well as their passengers. This provision aims to reduce the risk of head injuries in case of accidents.
The Act often specifies standards for helmets, including materials, construction, and safety features. These standards are intended to ensure that helmets provide adequate protection to riders in the event of a crash or collision.
The Act imposes penalties on riders and passengers who fail to wear helmets while riding two-wheelers. The penalties may include fines, license suspension, or other punitive measures depending on the severity of the violation and the laws enforced by local authorities.
