Detained MP Amritpal Singh Approaches Punjab & Haryana HC to Attend Parliament’s Budget Session

Detained MP Amritpal Singh moved the Punjab and Haryana High Court seeking permission to attend Parliament’s upcoming Budget Session after missing the Winter Session. His earlier plea for virtual participation became infructuous as the hearing concluded without a decision.

CHANDIGARH : After being absent from Parliament’s Winter Session, detained MP Amritpal Singh has approached the Punjab and Haryana High Court, requesting permission to attend the upcoming Budget Session. The petition is expected to be considered by a Division Bench on Thursday.

Amritpal had previously missed the Winter Session because his earlier request to attend Parliament virtually became irrelevant, as the hearing could not reach a conclusion despite the Bench addressing the matter almost daily.

According to the state, Amritpal, along with a large armed entourage carrying swords and firearms, allegedly stormed the premises to secure the release of one of his associates. The Punjab government claimed this incident amounted to a direct defiance of state authority and highlighted the inadequacy of ordinary criminal law in addressing the situation.

The government further stated that intelligence agencies had received credible inputs suggesting that Amritpal and his associates had drawn up a “hit list” of police officers and other perceived opponents. The existence of such a list, it was argued, reflected an imminent threat to public officials and overall public safety, justifying the need for preventive detention.

The Punjab government also accused Amritpal of deliberately radicalising youth through provocative speeches and extensive use of social media, glorifying violence and portraying himself as an alternative centre of authority. These activities, the state alleged, were intended to reignite separatist tendencies and weaken the sovereignty and integrity of India.

Amritpal Singh, who has been detained under the National Security Act since April 2023 and is currently held in Dibrugarh Central Jail, appeared before the Bench via videoconferencing on December 16, 2025, due to the lawyers’ decision to abstain from work.

On the previous hearing, the Khadoor Sahib MP stated that all activities in his parliamentary constituency have come to a halt because of his ongoing detention. He argued that his NSA detention has hindered him from discussing important public issues such as floods, drug problems, and alleged fake encounters during parliamentary sessions.

Earlier, Amritpal told the court that,

“The issue is not about me alone. It concerns the electorate I represent. Their parliamentary voice is not being heard,”

Earlier, the Bench had indicated that the petitioner could return to court when a new cause of action emerged, implying that he could raise the issue in a future parliamentary session.

In its detailed order, the Bench acknowledged that effective hearings could not occur on December 15, 16, and 17, 2025, due to lawyers’ abstention from work. Additionally, it documented the information provided by the petitioner’s counsel that the Winter Session of Parliament was set to conclude on December 18, 2025.

Since the arguments from respondents remained unfinished on December 15 and the last session was approaching, the Bench concluded that the matter had “virtually become infructuous.”

The issue is currently pending before the High Court following a petition filed by Amritpal challenging the validity of his third successive detention under the National Security Act. He has been lodged in Dibrugarh jail in Assam since April 2023 pursuant to an initial detention order issued on March 18, 2023.
