The Allahabad High Court Yesterday (May 1st) denied bail to Uttar Pradesh Member of Legislative Assembly (MLA) Abbas Ansari in a case alleging that his wife had been visiting him in jail without complying with the formalities.

Justice Jaspreet Singh stated that the Court was hesitant to grant bail to Ansari at this point since the testimonies of eye-witnesses and police personnel had not been presented in the case.
The Court remarked,
“Taking into account the applicant’s profile, family background, and past history, the allegations cannot be entirely dismissed.”
The court’s decision came against the backdrop of objections raised by the State, which highlighted that Nikhat Ansari had previously secured bail from the Supreme Court, primarily due to her responsibilities as a mother to a one-year-old child. The State’s opposition was rooted in concerns over the nature of the access she enjoyed during her visits to the jail.
“The members of the Legislative Assembly are also the law makers and in juxtaposition, it is not appropriate that a law maker may be seen as a law breaker,”

In a critical observation, the Court noted that such unrestricted access as Nikhat experienced is not typical. The judges were particularly alarmed by the recovery of two mobile phones from her during her time in the jail premises.
She was found in a restricted area, which she could not have accessed without implicit consent from the jail authorities, suggesting a lapse in standard procedures.
“The recovery of two mobile phones from the wife of the applicant who was found in the Jail premises in a room where she could not have access unless the Jail Authorities turned a blind eye,”
-remarked the Court, underscoring the gravity of the breach and its implications on the integrity of the penal system.
The case has highlighted potential systemic issues within the penal administration and raises questions about the consistency of law enforcement practices. The court’s firm stance in this matter reflects a commitment to upholding the law and ensuring that justice is not compromised by undue influence or special privileges.
