NEW DELHI: The Delhi High Court is set to hear a plea on August 5 concerning alleged negligence by a contractor and officials from the Delhi Development Authority (DDA). This negligence reportedly led to the tragic deaths of a woman and her three-year-old son, who fell into a waterlogged drain.
The petition, filed by Jhunnu Lal Srivastava, was presented before Acting Chief Justice Manmohan and Justice Tushar Rao Gedela. However, the judges declined an urgent request to list the petition for a hearing today(on 2nd August). The heart-wrenching incident occurred on July 31 in East Delhi’s Ghazipur area, where the victims, Tanuja and her son Priyansh, drowned in an under-construction drain.
The plea seeks not only accountability for this specific incident but also broader compensatory measures and policy changes aimed at preventing similar tragedies in the future. The petition has emphasized the necessity for a comprehensive safety audit of all ongoing drain construction projects to ensure such fatal accidents do not recur.
The plea lists several respondents, including the DDA, the Lieutenant Governor of Delhi, Delhi Police, and the Union Ministry of Housing and Urban Affairs. By involving these entities, the petition aims to address the systemic issues and negligence that contributed to this devastating event.
The tragic drowning of Tanuja and her young son has underscored the urgent need for rigorous safety protocols and accountability measures in public infrastructure projects. The case highlights the potential dangers posed by inadequate safety measures in construction zones, particularly those involving public utilities like drainage systems.

The incident has sparked a wave of concern and calls for immediate action to safeguard citizens from similar risks. The petition aims to bring about tangible changes that will enhance safety and prevent further loss of life due to negligence.
The court’s decision on this plea could set a precedent for how negligence in public infrastructure projects is addressed and rectified. The involvement of multiple high-level respondents indicates the seriousness of the issue and the need for a coordinated response to prevent such tragedies.
