Manish Sisodia’s Bail Denied by Delhi High Court in CBI, ED Cases

Today, On 21st May, The Delhi High Court denied bail to Manish Sisodia, former Delhi Deputy Chief Minister, in cases investigated by the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED). These cases are related to alleged irregularities in Delhi’s liquor policy. The court cited the seriousness of the charges and the potential for tampering with evidence as reasons for the denial.

New Delhi: The Delhi High Court declined to grant bail to Manish Sisodia, a prominent member of the Aam Aadmi Party (AAP), in relation to the cases filed against him by the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) regarding the Delhi excise policy case.

Justice Swarana Kanta Sharma dismissed Sisodia’s bail application, stating that the prosecution had presented a strong case of money laundering under Section 3 of the Prevention of Money Laundering Act (PMLA).

The Court described Sisodia’s actions as a significant betrayal of democratic principles, leading to the rejection of his plea for bail. Furthermore, the Court noted that Sisodia allegedly engaged in the destruction of crucial evidence, including electronic evidence. Specifically, reference made to two mobile phones that reportedly damaged.

Additionally, the Court took into consideration Sisodia‘s influential position within the Delhi government, where he held multiple portfolios, as well as his senior leadership role in the AAP.

The High Court stated,

“The court believes that the petitioner has not presented a sufficient case to warrant the granting of bail,”

Sisodia’s recent bail plea in the CBI and ED cases against him rejected by the trial court, prompting him to file a plea before the High Court. This marks the second round of bail applications made by Sisodia.

Previously, in 2023, Sisodia’s initial round of bail applications had been denied. On March 31, 2023, his bail plea in the CBI case was rejected, followed by the rejection of his bail application in the ED case on April 28, 2023. Both the trial court’s decisions, upheld by the Delhi High Court, and later affirmed by the Supreme Court in October 2023. However, the Supreme Court stated that Sisodia could reapply for bail if the trial proceedings progressed slowly.

Consequently, Sisodia submitted a second round of bail pleas. He has been in custody since February 26, 2023, and under investigation by both the CBI and the ED in connection with the Delhi excise policy case.

The case revolves around allegations that Delhi government officials collaborated to grant liquor licenses to specific traders in exchange for bribes. The accused officials are suspected of manipulating the excise policy to favor certain liquor vendors.
