UTTAR PRADESH: The Allahabad High Court has expressed concern over the lack of adequate safeguards for women receiving training from male gym instructors. Justice Shekhar Kumar Yadav made the observation while hearing a criminal appeal filed by gym trainer Nitin Saini, accused of caste-based abuse and harassment of a woman client.
The Case: Allegations Against Gym Trainer
According to the FIR, Nitin Saini, who runs a gym named Fit & Lift in Meerut, allegedly abused a woman customer, Anita, on April 29, 2024, by addressing her with a caste-based slur “Chamari Chamatti,” pushing her, and forcing her out of the gym premises.
The victim also alleged that Saini had made obscene videos of her friend Aarti and had been sending them to her over the past several months. These allegations have attracted charges under the Indian Penal Code (Sections 354 & 504) as well as the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
Court’s Observations
Justice Yadav observed,
“It is a matter of serious concern that presently male gym trainers are imparting training to female clients without adequate safeguards to ensure their safety and dignity.”
The Court highlighted the pressing need for protective measures in gyms to prevent harassment, abuse, or exploitation of women clients.
Directions to Police
The Court directed the Investigating Officer of Police Station Brahmpuri, Meerut, to file a personal affidavit addressing three key questions:
- Whether the gym operated by the accused was duly registered under the law.
- Whether the accused had been arrested in connection with the case.
- Whether the gym had female trainers on staff.
