The long-running Maggi trademark dispute reaches its conclusion as the Delhi High Court approves a settlement with Shree Shankeshwar Utensils over the ‘Maggisun’ brand. Nestlé retains exclusive rights, and all pending cases are now disposed of.

NEW DELHI: In a recent development for trademark law in India, the Delhi High Court has officially closed the long-running trademark infringement case filed by Nestlé S.A., the maker of the iconic instant noodle brand Maggi, against Shree Shankeshwar Utensils & Appliances Pvt. Ltd.
The dispute, which began in 2018, revolved around the manufacturing and sale of pressure cookers under the brand name Maggisun. Nestlé had argued that the name Maggisun was deceptively similar to its well-known Maggi trademark and constituted infringement.
The case, heard by Justice Tejas Karia, was recently resolved through a mutual settlement. Under the terms of this settlement:
- Shree Shankeshwar Utensils & Appliances acknowledged Nestlé as the rightful proprietor of the Maggi trademark and recognized the validity of all its trademark registrations.
- The defendant agreed not to manufacture, sell, advertise, or promote any products under the name MAGGISUN or any name similar MAGGI in any form of media, including print, electronic, social media, or e-commerce platforms.
- The company consented to the cancellation of its MAGGISUN trademark registration, clearing the way for Nestlé’s pending petition.
- Shree Shankeshwar Utensils & Appliances confirmed it had not filed any other trademark or copyright applications related to MAGGISUN or MAGGI and agreed not to do so in the future.
Justice Karia formally decreed the suit in accordance with the settlement and directed the drawing up of a decree sheet, stating,
“The parties are directed to be bound by the terms of the settlement.”
All pending applications related to the case have also been disposed of.
