Not Fit to be a Lawyer if You Put These Sort of Posts: Delhi High Court Slams Lawyer Over Facebook Post on Bar Association Elections

NEW DELHI: The Delhi High Court has expressed serious concern over a social media post made by an advocate alleging irregularities in the New Delhi District Court Bar Association (NDBA) elections held in March 2025.

In the case of Vipin Kumar Sharma Vs. The Returning Officer NDBA Elections, 2025, Justice Mini Pushkarna censured the advocate for making “incendiary and scandalous allegations” on Facebook, stating that such behavior is unbecoming of a legal professional.

“You are not fit to be a lawyer if these are the sort of posts you put. Election is never friendly, especially bar ones. This does not give you the justification to post all this,”

Justice Pushkarna remarked.

She further expressed her inclination to refer the matter to the Bar Council of India (BCI).

The Court also instructed Advocate Mehmood Pracha, representing the lawyer responsible for the post, to ensure that the offending social media content is deleted.

“The dignity of the court has to be maintained. You are personally responsible to ensure that it is deleted. The court does not expect Bar leaders to be like this,”

Justice Pushkarna added.

Advocate Pracha admitted that the Facebook post was false and tendered an unconditional apology on behalf of his client. In its order, the Delhi High Court acknowledged the apology but emphasized the seriousness of the matter. However, considering the nature of the case and the apology offered, the Court chose not to initiate contempt proceedings.

“This Court has taken a very serious view of the Facebook post. The court was inclined to initiate contempt proceedings and refer the matter to the BCI. However, considering the unconditional apology tendered by the counsel, the Court has accepted it, while cautioning against future misconduct,”

the order stated.

The warning serves as a reminder to legal professionals that social media posts affecting the dignity of the court will not be tolerated.

The petition in question pertained to alleged irregularities in the NDBA elections conducted at Patiala House Courts earlier this year.
