Today, On 30th September, The Allahabad High Court scheduled the next hearing in the Krishna Janmabhoomi-Shahi Idgah dispute for October 16. The case revolves around a long-standing legal battle over the ownership of land in Mathura, where both a temple and mosque are located. The court is examining claims related to the site’s historical and religious significance.

Justice Mayank Kumar Jain is overseeing the case, which involves intricate litigation surrounding the historic and religious site in Mathura.

During Monday’s session, the court observed that objections to a proposed amendment by the Hindu litigants had not yet been submitted.
This amendment is crucial to one of the 18 lawsuits filed by the Hindu side, which seeks possession and the restoration of a temple they assert was demolished to construct the Shahi Idgah mosque during Mughal emperor Aurangzeb’s rule.
Justice Mayank Kumar Jain, who previously dismissed a plea from the Muslim side on August 1, 2024, challenging the admissibility of the Hindu litigants’ suits, confirmed that these suits are not limited by the provisions of the Limitation Act, the Waqf Act, or the Places of Worship Act, 1991.
The latter act generally forbids altering the status of religious sites as they stood on August 15, 1947.

The litigation also includes a motion from the Muslim side requesting the withdrawal of a January 11 order, which had consolidated all related cases into a single hearing to streamline the judicial process. The core issue centers on the Shahi Idgah mosque in Mathura, which the Hindu litigants claim was constructed over a temple at Lord Krishna’s birthplace a dispute with deep religious and historical significance.
Meanwhile, the Muslim side, represented by the management committee of Shahi Idgah and the UP Sunni Central Waqf Board, has contested these claims on various legal grounds.
