Shahi Idgah Dispute Case || Allahabad HC Sets March 5 for Hearing

The Allahabad High Court set March 5 for hearing the case related to the Shahi Idgah dispute. The case involves a legal battle over the ownership of the site. The Muslim side had filed an application to amend its petition. The court will now consider the request and proceed with the hearing.

Prayagraj: The Allahabad High Court scheduled the next hearing for the Krishna Janmabhoomi-Shahi Idgah dispute in Mathura for March 5.

During the proceedings, the Muslim side submitted an application to amend its petition. Since a copy of this amendment was not provided to the Hindu side, the court ordered that it be shared and set the next hearing date for March 5.

To date, the Hindu side filed 18 suits seeking possession of the land following the “removal” of the Shahi Idgah mosque structure, along with requests for the restoration of the temple and for a permanent injunction.

On August 1, 2024, the high court dismissed a plea from the Muslim side that challenged the maintainability of the Hindu worshippers’ suits. The court ruled that these suits are not barred by the Limitation Act, the Waqf Act, or the Places of Worship Act, 1991, which prohibits the alteration of any religious structure that existed on August 15, 1947.

Additionally, on October 23, 2024, the high court rejected a request from the Shahi Idgah mosque committee to set-aside its January 11, 2024 ruling that consolidated all suits related to the Krishna Janmabhoomi-Shahi Idgah dispute.

The Hindu side’s cases assert the “removal” of the Aurangzeb-era mosque, which they contend was constructed after demolishing a temple that previously occupied the site.

The dispute arises from claims by Hindu petitioners who argue that the Shahi Idgah mosque was built over the birthplace of Lord Krishna. According to them, the site originally housed the Krishna Janmabhoomi temple, which was allegedly demolished during Mughal Emperor Aurangzeb’s rule in the 17th century.

The Hindu side demands the removal of the Shahi Idgah mosque and the restoration of the temple. Several suits have been filed seeking ownership of the land and a permanent injunction against the use of the mosque.
