Kerala High Court gave one-week emergency parole to a life convict so he can help his son join higher secondary school. The Court said a father’s presence is important for a child’s bright future.
Thank you for reading this post, don't forget to subscribe!KOCHI: The Kerala High Court allowed a convict, who is serving a life sentence at the Central Prison in Malappuram, to go on emergency leave for one week. The reason for this temporary parole was to help his son get admission into higher secondary education.
The order was passed by Justice PV Kunhikrishnan, who said that even though people in jail lose some rights, they still have basic rights as parents, especially when it comes to their children’s education.
The Judge clearly explained this in the order:
“The basic rights of the convict includes the right of a father to get good education (for) his child. A father’s presence plays a vital role in child’s higher education journey by offering emotional support, guidance and mentorship. It is true that, when a convict is in jail, the convict will lose some of his rights. But, the child of the convict should get the presence of his father for few days for a successful education year.”
This case was filed by the convict’s wife. She requested the court to give her husband emergency parole so that he could support their son during this important time. According to her, their son had just passed the SSLC (Secondary School Leaving Certificate) exam with excellent grades — six A+ and two A grades. She said that they needed the father’s help to secure admission in a higher secondary course.

Earlier, the jail officials had rejected the parole request. They said that their rules did not allow parole for this kind of reason. So, the convict’s wife approached the High Court for help.
The High Court carefully considered the child’s good academic performance and the real reason behind the leave request. The Court observed that the presence of the father at this moment could make a big positive difference in the child’s future.
“Let the bright child of the convict namely XXXX, who secured six A+ in SSLC examination, spend a few days with his father. XXXX should go to the plus two course after getting blessings from his parents with a smile on their face. Let the almighty give blessings to XXXX for a bright future,”
-the Court stated.
After looking at all the facts and hearing both sides, the Court decided to approve the emergency parole. The convict was allowed to leave the prison for seven days.
The convict’s wife was represented by a legal team consisting of advocates PK Varghese, MT Sameer, Jerry Mathew, Justin KK, Devika KR, Sawparnika Raju, and Siyad Ummer.
The State was represented by Senior Public Prosecutor Hrithwik CS.
