Kerala HC Grants Bail to Man Who Attacked Mother Over New Year’s Money: ‘No Purpose in Blaming Youth’

Kerala HC Grants Bail to Man Who Attacked Mother Over New Year’s Money: 'No Purpose in Blaming Youth'

KOCHI: The Kerala High Court granted bail to a 25-year-old man accused of attacking his mother because she refused to give him money for New Year’s Eve celebrations.

While hearing the bail application, the court, with a Single Judge Bench led by Justice P.V. Kunhikrishnan, shared deep concerns about the mental state of today’s youth.

The court observed,

“There is no purpose in blaming the young generation. The society and parents should watch them closely and monitor that their relationship is with good people.”

As per the prosecution, the accused, Sammil, had asked his mother for money to celebrate New Year’s Eve. When she refused, he allegedly left the house, returned with a knife, and attacked her, causing serious injuries to her head, face, and hands.

The prosecution claimed that his intent was to kill her. The police arrested him on January 1, 2025, and charged him under Sections 118(1) (voluntarily causing hurt by means of any instrument for shooting, stabbing, or cutting) and 109 (attempt to murder) of the Bharatiya Nyaya Sanhita (BNS), 2023.

Expressing concern over the mindset of the younger generation, the court remarked,

“The mental condition of the youngsters of our country is astonishing and disturbing. For not paying money for celebrating New Year’s Eve, the petitioner attacked his own mother and inflicted serious injuries.”

Though the court acknowledged the seriousness of the crime, it emphasized that mere criticism of the younger generation would not help. Instead, it stressed the importance of proper guidance from parents and society.

Initially, the court was hesitant to grant bail unless the mother, who was the victim, explicitly stated that she had no objection. Later, the mother submitted an affidavit, stating that she could not bear to see her son in jail.

The court noted her words:

“എന്റെ മകൻ ജയിലിൽ കഴിയുന്നതിൽ ഒരമ്മ എന്ന നിലയ്ക്കു എനിക്ക് സഹിക്കാൻ പറ്റുന്നില്ല” (As a mother, I cannot bear to see my son in jail).

Recognizing the emotional suffering of the mother, the bench observed,

“This sentence contains the tears of this unfortunate mother. I am sure that the wounds on her body might not have been healed. But her love for her son overtakes the wounds. Thinking about the fate and trauma facing the mother, I am forced to grant bail to the petitioner. A mother’s love for her son is like a rose – it will bloom forever.”

Based on these considerations, the court decided that keeping the petitioner in custody would only add to his mother’s suffering.

The court concluded,

“No purpose will be served by retaining this youngster in detention, to continue the trauma of his mother.”

Finally, the court granted bail to the petitioner under strict conditions. It also made it clear that if he violated any of these conditions, his bail would be canceled.
