Bengaluru: The Karnataka High Court on Wednesday quashed the First Information Report (FIR) filed against Karnataka BJP President BY Vijayendra regarding an alleged offensive post on social media platform X, posted from the official handle of the State BJP unit.

Justice M Nagaprasanna presided over the matter and concluded that the Court was “closing” the case, issuing orders to quash the FIR along with all associated proceedings. A detailed order from the Court is yet to be released.

Representing Vijayendra, Senior Advocate Aruna Shyam clarified to the Court that the controversial post was merely a political comment directed at the Congress government in Karnataka and its governance style.

Shyam argued that there was no violation under Section 505 (2) of the Indian Penal Code (IPC), which pertains to promoting enmity between different communities.

“No offence of promoting enmity between communities under Section 505 (2) of the IPC was made in the case,”

-Shyam emphasized.

The FIR in question was filed in April after a complaint from the Election Commission’s flying squad. The complaint accused the Karnataka BJP of posting comments against Chief Minister Siddaramaiah and other Congress leaders.

The complainant further alleged that the tweet claimed the Congress party was attempting to appease the Muslim community ahead of the parliamentary elections earlier this year.

The High Court’s decision to quash the FIR marks a significant development, particularly in light of the politically charged atmosphere in the State. A more detailed order from the Court is anticipated for further clarity.
