UTTAR PRADESH: The Allahabad High Court made a unique and thought-provoking observation during the hearing of an alimony dispute involving an elderly couple aged 76 and 80.

Justice Saurabh Shyam Shamshery, presiding over the case, expressed concern about the increasing number of such legal conflicts, remarking that

“it seems that Kalyug (the age of darkness in Hinduism) has arrived.”

In Hinduism, ‘Kalyug‘ refers to the current age of conflict, sin, and discord.

This observation was made in response to the troubling nature of family disputes extending into late stages of life, where peace and reconciliation are often hoped for.

The dispute involves Munesh Kumar Gupta, an 80-year-old retired health supervisor, and his 76-year-old wife. The couple had been embroiled in a property dispute since 2018. When the disagreement escalated, it led to police involvement, and they were eventually referred to a family counselling centre in an attempt to mediate the conflict.

Unfortunately, the counselling sessions did not bring about any resolution, and the couple decided to live separately. Gupta’s wife subsequently filed a petition in family court, seeking alimony of Rs 15,000 per month from her husband. At the time, Gupta was receiving a monthly pension of approximately Rs 35,000.

In an order issued on February 16, the family court ruled that Gupta should provide Rs 5,000 as alimony to his wife. However, Gupta challenged the family court’s order in the Allahabad High Court, leading to the current proceedings.

During the hearing, Justice Saurabh Shyam Shamshery made a poignant remark, stating,

“It seems that Kalyug has arrived. Such legal battles are a matter of concern.”

The remark was a reflection of the distressing nature of family disputes between elderly individuals, which is contrary to the traditional values of respect and harmony in old age.

While issuing a notice to Gupta’s wife, the court expressed hope that the couple would attempt to reach an amicable settlement before the next hearing. The notice allows for further dialogue between the parties, with the goal of avoiding prolonged legal battles, particularly in such emotionally and financially taxing situations.

The Allahabad High Court’s observation in this case highlights a broader concern about the state of familial relationships and legal disputes, especially in the later stages of life. The court’s reference to ‘Kalyug’ serves as a symbolic reminder of the erosion of traditional values and increasing discord in society.

The case not only brings attention to the personal struggles of the elderly couple but also shines a light on the growing number of family disputes making their way into the legal system.

As the case continues, both the court and society at large will be watching closely, hoping that the couple finds a peaceful resolution, reflecting the need for harmony and understanding in personal and family matters.
