The case came up before Justice Amit Bansal, who heard the matter and gave important directions. The judge told Choudhary’s lawyer that they must make the creators and uploaders of the questioned content a part of the case.
Until now, only the platforms were named, but the Court made it clear that those who actually made or uploaded the videos also need to be included as parties.
Justice Bansal also asked Google and Meta to share full details of the Facebook pages and YouTube channels that uploaded the videos. This information has to be given so that the individuals behind the content can be identified and brought before the Court.
During the hearing, the Court noticed that Choudhary had not submitted the transcripts or copies of the videos he is complaining about. These videos reportedly show him in a telephonic conversation with a woman, and the content is alleged to be sexually suggestive.
The Court said that without the actual material being placed on record, it cannot consider his request for immediate protection.
Because of this, Justice Bansal directed him to file the video copies and transcripts first. After these documents are submitted, the Court will examine his plea for interim relief.
His request for a temporary injunction – asking the Court to immediately block or remove the videos – will now be heard on January 13.
Surinder Kumar Choudhary currently serves as the ninth Deputy Chief Minister of Jammu and Kashmir. He represents the Nowshera constituency in the Jammu and Kashmir Legislative Assembly as a member of the Jammu & Kashmir National Conference (JKNC).
