New Delhi: The Delhi High Court heard a high-profile inheritance dispute involving the family of the late businessman Sunjay Kapur. The case is being heard by Justice Jyoti Singh.

During the hearing, senior advocate Mahesh Jethmalani raised serious concerns over the authenticity and execution of Sunjay Kapur’s will. He described the document as a “clumsy forgery,” questioning why someone with such a substantial estate did not consult a lawyer.

He further asked,

“who actually drafted it not a legal professional,”

highlighting the possibility that the will may not have been prepared with proper legal formalities.

Jethmalani also criticized the executor of the estate, saying they

“failed in duties not collecting assets properly, blindly trusting Priya Kapur, and acting as if the estate already vests in D1.”

He pointed out that the plaintiffs, including Sunjay Kapur’s mother, were

“disinherited without explanation,”

raising questions about the fairness and legality of the will.

According to submissions in court, the will was created as a Microsoft Word file and shows no clear involvement of Sunjay Kapur himself.

Digital evidence presented in court reportedly

“points to conspirators,”

suggesting that individuals may have manipulated the document for their benefit. Additionally, the court noted that

“No affidavits filed by attesting witnesses, a legal requirement,”

further casting doubt on the legitimacy of the will.

The matter has now been adjourned, with the next hearing scheduled for October 13. Legal experts believe this case could set important precedents for inheritance disputes, particularly involving electronic documents and questions of authenticity.

This case has drawn significant attention because it raises critical questions about estate management, the responsibilities of executors, and the safeguards needed to prevent forgery in high-value inheritance cases.

The court will examine whether the digital will can be accepted as valid and whether the executor and beneficiaries acted in compliance with legal obligations.
