Madras: Shockingly, Rs.100 crore defamation case filed by cricketer Mahendra Singh Dhoni, the Madras High Court has refused to review its earlier order that allowed Dhoni to question the television channel News Nation as part of the legal proceedings.

The defamation lawsuit was originally filed in 2014 by MS Dhoni against News Nation, Zee Media, and retired IPS officer G Sampath Kumar.

The case revolves around allegations that these parties tried to link Dhoni to the IPL match-fixing scandal. Dhoni strongly denied these claims and sought legal action for damaging his reputation.

On Friday, Justice AA Nakkiran passed a new order in the case, rejecting a review petition filed by News Nation. This petition was an attempt to reverse a 2022 order that had allowed Dhoni to serve interrogatories (formal written questions) to News Nation to gather details about the basis of their reporting.

News Nation’s lawyers argued that their previous counsel had “inadvertently” given a no-objection to Dhoni’s request for interrogatories without getting proper instructions from the channel. They claimed this mistake allowed Dhoni to misuse the court process just to “prolong the trial.”

They further said that “the nature of the interrogatories for each defendant in the suit differed and should be considered individually on their merits.”

In response, Dhoni’s legal team said a review could only be allowed if there had been a clear oversight, or if the earlier decision was flawed or caused injustice. They pointed out that a division bench of the same court had already rejected a similar request by the other parties involved in the case. That earlier order refused to strike down the interrogatories, thereby supporting Dhoni’s right to ask questions.

As per Dhoni’s team, a review was not justified because none of the legal requirements for reviewing a case were met.

Justice AA Nakkiran, after going through all the facts and referring to the observations made by the division bench, ruled that the application filed by News Nation was “not at all maintainable.”
