Despite Saturdays being a non-working day, the court deemed the matter “very urgent,” highlighting the gravity of the situation.
A division bench, comprising Justices Salil Kumar Rai and Divesh Chandra Samant, directed state authorities to produce Shane Ali and Rashmi before the court at 12 noon on Saturday. The directive comes in response to a habeas corpus petition filed by Tehseem, Shane’s brother, through Advocates Ali Bin Saif and Kaif Hasan.

Background of the Case
Shane Ali and Rashmi, both adults, reportedly went missing shortly after a court hearing on October 15. The hearing arose from a case lodged by Rashmi’s father, who alleged that Shane had abducted his daughter after she eloped with him.
During the hearing, Rashmi had appeared in court and made it clear that she was living with Shane of her own free will and intended to marry him. Despite this, the petition states that the couple could not be traced after leaving the court premises.
The habeas corpus plea alleges that, despite earlier High Court directions to provide police protection to the couple, no such protection was extended. Instead, Shane’s family claims that the police continued to harass them, including Tehseem.
Alleged Threats and Harassment
The petition details that Shane had informed his brother that Rashmi’s father and four to five masked men had tried to prevent the couple from entering the court. Later, Shane reported being followed by the same group. The government advocate was then instructed by the court to contact the Station House Officer (SHO) and ensure the couple did not leave Prayagraj city limits.
Shane’s brother also approached the Civil Lines Police Station to lodge a written complaint but was redirected to the Civil Lines chowki. Despite waiting for hours, no FIR was registered. The petition claims that Shane’s life is in danger, citing attempts by the masked men to physically assault him outside the court.
Court’s Urgent Intervention
Given the circumstances, the habeas corpus petition seeks urgent intervention from the High Court to direct the police to trace and produce Shane and Rashmi before the court. The plea emphasizes that failure to act could result in “irreparable loss and injury” to the petitioner and the couple.
