Illegal Construction on HIDCO Land | Justice Sinha Orders Cessation of Party Office Project in Rajarhat
Calcutta High Court| Justice Amrita Sinha

KOLKATA: On Tuesday(21st May), The Calcutta High Court has once again taken strict action against illegal construction on HIDCO land. Justice Amrita Sinha, who had previously ordered the demolition of Trinamool Congress offices, has now directed a stop the construction of four offices belonging to the Communist Party of India (Marxist) (CPM) and the Bharatiya Janata Party (BJP) in the Rajarhat area.

On Tuesday, Justice Sinha issued an order for the immediate stoppage of these constructions. In addition to halting the construction, the authorities have been instructed to make a decision regarding the demolition of the CPM and BJP party offices that have been built on HIDCO land in the area.

Earlier on May 10, Justice Sinha had directed the demolition of three Trinamool Congress offices that were illegally constructed on HIDCO land in the Rajarhat and New Town areas.

The High Court was informed by the petitioners in that case that-

“An additional 35 political offices have been constructed on HIDCO land in New Town and Rajarhat regions, with several still in the process of being built.”

An evidently frustrated Justice Sinha questioned the HIDCO authorities during the hearing-

“Why hasn’t HIDCO been able to safeguard its property? Are there no specific laws in place to deter illegal construction on their land?”

Justice Sinha’s pointed questions reflect the court’s dissatisfaction with HIDCO’s inability to prevent illegal encroachments. The High Court’s actions come in response to a series of petitions highlighting the unauthorized occupation of HIDCO land by various political parties.

This recent directive from Justice Sinha underscores the judiciary’s commitment to upholding the law and ensuring that public land is not misused for political gains. The court’s intervention is expected to set a precedent for stricter enforcement of land use regulations in the future.

The issue of illegal construction on HIDCO land has been a longstanding problem in the Rajarhat and New Town areas. The land, which is intended for public and developmental use, has been frequently encroached upon by political entities, leading to unauthorized constructions.

The High Court’s involvement began when petitions were filed by concerned citizens and organizations, bringing to light the extent of illegal encroachments. During the hearings, Justice Sinha’s firm stance and direct questioning have emphasized the need for immediate action.

In addressing the matter, Justice Sinha remarked-

“The law should be enforced, and it’s imperative to safeguard public land from unauthorized utilization.”

The court’s orders are aimed at restoring the intended use of HIDCO land and preventing future encroachments.

The demolition orders for the Trinamool offices, along with the current halt on CPM and BJP constructions, mark a significant step in addressing the illegal occupation of public land. The court’s actions serve as a warning to all political parties and entities engaging in similar activities.

Justice Sinha’s proactive measures have been widely welcomed by residents and civic groups in the Rajarhat and New Town areas, who have long been advocating for the protection of public land. The court’s decisions are expected to pave the way for more stringent monitoring and regulation of land use in these areas.

As the High Court continues to address the issue, the role of HIDCO in safeguarding its property will come under closer scrutiny. The court’s directives highlight the importance of transparency and accountability in managing public assets.
