Gujarat High Court Judge Extends Public Apology After Tense Exchange in Courtroom

In an unexpected turn of events at the Gujarat High Court, Justice Biren Vaishnav publicly apologized to his colleague, Justice Mauna M. Bhatt, following a tense disagreement that had transpired between them during a court session. This act of contrition was notably made in the presence of a host of advocates and court staff members, highlighting the gravity of the situation.

The disagreement that led to this public apology took place when Justice Vaishnav, who holds seniority on the bench, was dictating an order on a particular matter. As he was doing so, Justice Bhatt, apparently not in concurrence with the direction of the order, subtly whispered her reservations to Justice Vaishnav. This discreet act of dissent was met with a sharp response from the senior judge. He retorted,

“Then you differ yaar. We have differed in one, you differ here also.”

Attempting to clarify her position and perhaps defuse the escalating tension, Justice Bhatt responded,

“It’s not a question about differing.”

However, an evidently irked Justice Vaishnav shot back,

“Then do not murmur, you pass a separate order then. We are not taking any more matters.”

The intensity of the exchange culminated with Justice Vaishnav abruptly leaving the courtroom.

Addressing the courtroom in a subsequent session, Justice Vaishnav openly acknowledged the inappropriateness of the previous day’s events. He stated,

“What happened on Monday, shouldn’t have happened. I was wrong. I am sorry for that. We begin a new session. It shouldn’t have happened. It’s just that, I don’t know…I was wrong.”

The entire episode, given its rarity and the stature of the individuals involved, garnered significant attention. While the altercation was initially captured and broadcasted on YouTube, the decision was later made to remove the video from the platform.

This incident, while surprising to many, serves as a poignant reminder of the human dynamics and emotions that can come into play, even within the hallowed halls of the judiciary. It underscores the importance of open communication, mutual respect, and the ability to acknowledge one’s mistakes, regardless of one’s position or stature.
