Delhi High Court Issues Directions in Government of Canada’s Lawsuit Against Sanjay Madan Over Legal Dispute

The Delhi High Court issued directions in a civil case filed by the Government of Canada against Sanjay Madan, marking the next step in the legal proceedings.

The Delhi High Court issued directions in a civil case filed by the Government of Canada against Sanjay Madan and others, registered as CS(OS) 379/2025.

The matter was heard by Hon’ble Mr. Justice Girish Kathpalia, who delivered a brief yet important order concerning the continuation of the proceedings.

The Government of Canada was represented by Senior Advocate Mr. Arvind Nayar, alongside Mr. Vipul Agrawal, Mr. Jatin Kochhar, Mr. Arjun Kant, and Mr. Gunjan Joshi. The fourth defendant was represented by Mr. Ateev Mathur.

During the hearing, the Court was informed of an application for exemption from filing certain documents, designated as I.A. 14729/2025. The judge allowed this application.

Additionally, another application for an urgent hearing was submitted, numbered I.A. 14728/2025, which accompanied the main suit CS(OS) 379/2025.

The Court noted that the case had previously been unable to proceed due to the late payment of required court fees, resulting in an adjournment without a new date. However, the court recognized that the situation had now changed, as the fees had finally been paid.

The Court then provided further instructions for the next steps to be taken by the plaintiff.

Justice Kathpalia directed that if the plaintiff completes the necessary formalities by the following day, summons and notices must be issued to all defendants. He added that the case would be heard again on June 23, 2025.

The judge specified,

“Subject to plaintiff taking steps by tomorrow, dasti summons of the suit and notice of the applications be issued to all defendants, returnable on 23.06.2025.”

This case is being conducted through a combination of physical and hybrid hearings, as requested by the parties involved.
