Patna, Bihar: Recently, the Patna High Court ordered the release of Czech national Kasperek Petr, who was detained in Bihar for entering India without a valid visa. The court directed Petr’s deportation within 15 days and called upon the Czech Embassy in New Delhi to assist in his repatriation.
Justice Vivek Chaudhary, presiding over a single-judge bench, made this decision following a hearing of Petr’s petition.
Petr had entered India to report a cybercrime incident but was arrested at the Raxaul border crossing from Nepal for lacking a valid Indian visa. Initially sentenced by a judicial magistrate to two years in prison and a fine, Petr appealed the decision, challenging its validity before the High Court.
During arguments, Petr’s counsel contended that foreign nationals caught entering India should be immediately deported instead of facing criminal prosecution for visa violations, arguing that such legal actions were unjustified.
