The Delhi High Court has sought Priya Kapur’s reply in Rani Kapur’s suit challenging the family trust, while deciding not to pass any orders on the interim relief application today, keeping the status quo unchanged for now.
The Delhi High Court issued summons to Priya Kapur in a lawsuit brought forth by her mother-in-law, Rani Kapur, who is seeking the dissolution of the Rani Kapur Family Trust, estimated to be worth several thousand crores.
Justice Mini Pushkarna also directed notices to 22 additional defendants, including seven grandchildren of Rani Kapur, two of whom are the children of Bollywood actress Karisma Kapoor.
The Court stated that it will not rule on the interim relief application during this session.
The application aimed to maintain the status quo regarding the trust.
The Bench noted that the interim relief request will be reviewed on March 23.
The Rani Kapur Family Trust holds a stake in Sona Comstar, an automotive component manufacturer. Though the precise valuation of the trust remains undisclosed, it is believed to encompass several thousand crores.
A separate dispute concerning the control of Sunjay Kapur’s assets is already underway in the Delhi High Court.
Today, During the hearing, Senior Advocate Vaibhav Gaggar represented Rani Kapur, outlining the case’s background and recent developments since Sunjay Kapur’s passing in June of last year.
Gaggar pointed out that immediately following Sunjay’s death, Priya Kapur took steps to assume control over his assets, becoming the beneficiary of nearly 60% of the family’s wealth, while 40% was allocated to the children, leaving her with nothing.
Gaggar stated,
“So, it is to be believed that within six months of marriage, I have executed the trust, divested everything and voluntarily said that if you [Sunjay] die, the family won’t have anything, but everything will go to them,”
He emphasized the necessity of safeguarding the estates.
On the opposing side, Senior Advocate Akhil Sibal represented Priya Kapur, asserting that the suit is not maintainable and that they intend to file a plea for its dismissal.
Sibal remarked,
“A trustee is challenging the trust. That can’t be done,”
Regarding the interim relief plea, the Court indicated it would review the responses submitted by the defendants before issuing any orders.
Gaggar pressed for full disclosure of all documents associated with the trust.
Justice Pushkarna remarked that nothing should be concealed from the Court.
Justice Pushkarna instructed Sibal,
“You [Priya Kapur] are required to reveal all information, including the meeting minutes and your accounts. You must not withhold any details from the court,”
Sibal responded that he would present documents to authenticate the trust and would comply if the court deemed any additional disclosures necessary.
He further mentioned that no application should be entertained on the first date. The Bench subsequently proceeded to issue summons and notice regarding the case.
In her lawsuit, the 80-year-old Rani Kapur has claimed that the trust was established fraudulently and has been used to remove her from her entire estate, including her influence over the Sona Group of companies. She has accused Priya Kapur, Sunjay Kapur’s widow, of being the “chief mastermind” behind the alleged conspiracy.
Rani Kapur alleges that Priya Kapur acted quickly after Sunjay Kapur’s death to take control of crucial Sona Group companies without notifying her.
The lawsuit asserts that after Rani Kapur suffered a stroke in 2017, her late son Sunjay Kapur and his third wife, Priya Kapur, manipulated her physical dependence and trust to execute a complicated scheme that transferred all her assets to the RK Family Trust without her informed consent.
She contends that she was coerced into signing documents, including blank sheets, under the guise of administrative convenience.
The suit states,
“It is submitted that by means of a complex web of illegal transactions undertaken by the Defendant Nos. 1 [Priya Kapur] to 9 in an unfortunate collusion with the Plaintiff’s now deceased son, Late Mr. Sunjay Kapur, all the Plaintiff’s assets vest in one fraudulent Trust titled – RK Family Trust, without her knowledge. The entire fraud perpetrated upon the Plaintiff has only now been discovered post the demise of her Late Son, who also passed away under mysterious circumstances, on 12.06.2025, and the series of events that have unfolded immediately thereafter,”
Rani Kapur has named 23 entities as defendants in the case, including Priya Kapur and seven of her grandchildren, two of whom are children of Bollywood actress Karisma Kapoor.
Background of the Case
The personal estate dispute of late industrialist Sunjay Kapur has been pending before the Delhi High Court for several months and forms the background to the ongoing inheritance battle within his family. The case involves conflicting claims by his widow, Priya Sachdev Kapur, his mother Rani Kapur, and his children from his earlier marriage with actor Karisma Kapoor, namely Samaira Kapur and Kiaan Raj Kapur.
The dispute began after Sunjay Kapur’s children and his mother approached the High Court alleging that the will relied upon by Priya Kapur was forged.
They challenged its validity and claimed that it does not reflect Sunjay Kapur’s true intentions regarding his multi-million-dollar personal estate. As part of the civil proceedings, they sought an interim injunction to prevent Priya Kapur from dealing with or managing the estate until the issue is finally decided.
During the hearings, Priya Kapur denied all allegations of forgery and concealment of assets, while Sunjay Kapur’s mother questioned the disclosure of his income and bank balances.
Previously, Priya Kapur’s son challenged the authenticity of the will purportedly belonging to their father, opposing the claims made by Karisma Kapoor’s children and asserting that their challenge was founded on “speculation and guesswork.”
Earlier, On November 20, Priya Kapur informed the High Court that it is a customary practice for a husband to leave all his assets to his wife, countering the assertion made by Karisma Kapoor’s children that their father’s alleged will emerged under questionable circumstances.
The High Court had previously allowed Priya Sachdev Kapur to file a list of Sunjay Kapur’s movable and immovable assets in a sealed envelope. Justice Jyoti Singh was reviewing her request to submit these asset details confidentially, along with a commitment that neither party would share this information with the media.
