CHENNAI: The Madras High Court has mandated the Tamil Nadu Advocate General to provide a comprehensive report regarding the circumstances surrounding the deaths of the prime accused, A. Sivaraman, and his father. This directive comes in the wake of a disturbing case involving the rape of a 14-year-old girl and the sexual abuse of multiple minor students during a fraudulent National Cadet Corps (NCC) camp organized at a private school.

A bench comprising Acting Chief Justice D. Krishnakumar and Justice P.B. Balaji issued the order on August 28. The court instructed Advocate General P.S. Raman to present the findings from both the special investigation team and a multi-disciplinary team tasked with investigating the grave allegations.

This case emerged from a private school in Krishnagiri district, Tamil Nadu, where it was reported that 12 minor girls were subjected to sexual abuse by Sivaraman. The fraudulent NCC camp took place from August 5 to 9, 2023. Following a complaint from one of the victims, Sivaraman was arrested on August 19. Tragically, he died in a Salem hospital on August 23, just one day after his father allegedly perished in a road accident.

During the court proceedings, Advocate General P.S. Raman and State Public Prosecutor Hasan Mohamed Jinnah informed the judges that police investigations suggested Sivaraman had committed suicide by ingesting rat poison while in custody.

“His father, on the other hand, had died in an unrelated road accident.”

The court expressed grave concerns regarding the management of the private school involved, emphasizing that it had neglected its duty to safeguard its students. The judges questioned the school’s decision to host the NCC camp without conducting proper background checks on the organizers.

“The school should have conducted a thorough background check on anyone involved in organizing the camp. Due to the management’s failure to be diligent, an untrustworthy individual accessed the campus, damaging the school’s reputation as a safe learning environment.”

The judges further expressed their dismay at the implications of these events on the affected children.

“In other words, the school exposed vulnerable children to a dangerous situation with potential long-term effects on their physical, emotional, and psychological development. It is deeply disheartening and unacceptable that such heinous acts occurred in this supposedly safe environment.”

-they continued.

In response to these serious lapses, the court directed the District Legal Services Authority (DLSA) of Krishnagiri to conduct a thorough inspection of the private school. They were tasked with engaging with victims, parents, and other students to compile a detailed report before the court.

The High Court has ordered that the Advocate General and the DLSA submit their findings by September 4, 2023. This ongoing investigation not only seeks to address the specific incidents of abuse but also aims to hold accountable those responsible for the safety and welfare of the students.

The court’s actions highlight the urgent need for stricter regulations and oversight concerning the safety of minors in educational settings. Ensuring that such tragic events do not recur is paramount to restoring public confidence in the educational system and safeguarding the rights of children.
