E Abubacker's UAPA Case| Delhi High Court Denies Bail to Former PFI Chairman

Today, On 28th May, The Delhi High Court dismissed a plea by former PFI chairman E. Abubacker seeking release in a case under the Unlawful Activities (Prevention) Act (UAPA). Abubacker had sought release on medical grounds. The court found no sufficient basis for his plea, upholding his detention.

New Delhi: The Delhi High Court dismissed a plea filed by E Abubacker, the former Chairman of the Popular Front of India (PFI). Abubacker had sought his release in the Unlawful Activities (Prevention) Act (UAPA) case being investigated by the National Investigation Agency (NIA).

Abubacker arrested by the anti-terror agency during a major crackdown on the now banned PFI organization in 2022. He is currently in judicial custody.

Earlier, Abubacker approached the trial court, seeking interim bail on medical grounds, but his request denied.

Unsatisfied with the trial court’s decision, Abubacker then moved the Delhi High Court, hoping to secure his release. However, the High Court, now dismissed Abubacker’s plea, upholding the earlier order of the trial court.

A bench comprising Justices Suresh Kumar Kait and Manoj Jain as they delivered the verdict, declared ,

“The appeal is hereby rejected,”

Abubacker sought his release based on both merit and medical reasons.

As per the National Investigation Agency, an alleged criminal conspiracy formed by the Popular Front of India, its officials, and affiliates to procure funds for carrying out terrorist activities across the nation. Furthermore, it purported that training camps, being conducted to indoctrinate and prepare their members for such acts.

In September 2022, a large number of alleged Popular Front of India (PFI) activists detained or arrested across multiple states in India as part of a nationwide crackdown. The raids carried out by a joint operation led by the National Investigation Agency (NIA), targeting individuals suspected of supporting terrorist activities.

The arrests made in several states and union territories, including Kerala, Maharashtra, Karnataka, Tamil Nadu, Assam, Uttar Pradesh, Andhra Pradesh, Madhya Pradesh, Puducherry, Delhi, and Rajasthan. One of the individuals arrested Abubacker, who apprehended on September 22, 2022.

Following the raids and arrests, the Indian government banned the PFI and several of its associated organizations for a period of five years under the Unlawful Activities (Prevention) Act. The government accused the PFI of having links with global terrorist groups such as the ISIS.

In February, the high court instructed the Medical Superintendent of Tihar Jail to ensure that Abubacker receives regular and effective treatment for his medical conditions.The court also refused to impose house arrest on Abubacker, asserting that he would be hospitalized for treatment if deemed necessary.
