Jabalpur: The Madhya Pradesh High Court issued notices to BJP leader Rodmal Nagar and the Election Commission (EC) in response to a petition challenging Nagar’s election from the Rajgarh Lok Sabha seat.

The petition, filed by Congress leader Digvijaya Singh, questions the credibility of the Electronic Voting Machines (EVMs) used in the election and seeks to have Nagar’s election declared void.

Justice Hirdesh of the Indore bench issued the notices on Wednesday and scheduled the matter for further hearing on September 17. Singh, who lost to Nagar by a margin of 1.46 lakh votes, alleges in his petition that the system of EVMs is flawed and lacks credibility.

The petition references a Supreme Court directive from April 26, which led the EC to issue an administrative Standard Operating Procedure (SOP) on June 1 for testing and verifying the “burnt memory and microcontroller of EVMs.” Singh’s petition claims that a technical SOP, which was supposed to follow, has not yet been issued, raising doubts about the testing and verification process of the EVMs.

Singh has urged the high court to void Nagar’s election and has requested the EC to provide the entire record of the elections held in the Rajgarh constituency, including the hardware and software related to the EVM system.

The petition alleges that the EC failed to comply with the Supreme Court’s directions, significantly affecting the election result in Rajgarh.

Additionally, the petition questions the maintenance of VVPAT (Voter Verifiable Paper Audit Trail) units and the process used for inserting election symbols into their “flash memory.” Singh claims there is no information available about the “source” and “sanctity” of the applications or software used for this purpose, nor about the laptops or computers used to insert these symbols.

The high court’s notice to the EC and Nagar indicates the beginning of legal scrutiny over these allegations, with further developments expected in the upcoming hearings.
