Justice Amit Sharma, presiding over a vacation bench, specified in an order issued on Wednesday that no further extensions would be granted to Faizyab Masjid and Madarsa or any individuals associated with it to vacate the site.
“In view of the undertaking given by the caretaker of the petitioner before this court, respondent nos. 1 and 2 (religious committee and DDA) are directed to grant a period of one month to the petitioner or any other person claiming through it to vacate the subject premises, that is, mosque and madarsa situated at Sarai Kale Khan,” the court said.
The mosque and madarsa are located near the ISBT bus depot at Sarai Kale Khan in Hazrat Nizamuddin. The high court was addressing a plea challenging the actions of Delhi Police and DDA officials, who had threatened to demolish the mosque on June 13, labeling these actions as illegal, arbitrary, and unconstitutional.
The Delhi Religious Committee, represented by advocate Arun Panwar, had decided to remove unauthorized religious structures from public land.
The petition also requested that authorities provide copies of the orders, meeting minutes, and other relevant documents concerning the demolition decision, and to grant sufficient time for the petitioner to seek legal remedies.
It further sought to prevent any coercive actions against the mosque and madarsa until then. During the hearing, however, the petitioner’s counsel asked for a month’s time to vacate the premises.
The High court acknowledged the statement from the mosque’s caretaker and authorized representative, agreeing to vacate the premises within one month and not to hinder the authorities’ demolition efforts.
The court ordered the religious committee and the DDA to allow a one-month period for vacating the mosque and madarsa at Sarai Kale Khan.
The petition was withdrawn at the request of the petitioner, who agreed to comply with the caretaker’s undertaking.
