The Delhi High Court ruled against imposter domains infringing Tata Power Solar’s trademark, granting a permanent injunction and suspending fraudulent websites, underscoring the protection of intellectual property rights.

New Delhi: The Delhi High Court has taken strict action against imposter domains found to be infringing the trademark of Tata Power Solar Systems Limited.
Justice Amit Bansal issued the order while hearing a plea filed by Tata Power Solar Systems Limited against the illegal use of its trademark by four fake domain registrants:

In its February 13 order, the court observed that these fraudulent websites had copied Tata Power Solar’s well-known trademarks to mislead customers.
“A bare perusal of the impugned domain names and email addresses used by the defendants (imposter domain registrants) makes it apparent that the said defendants have slavishly copied the plaintiffs’ registered and well-reputed trademark ‘TATA’ and ‘TATA POWER SOLAR’ formative marks and the products of the said defendants bearing the impugned marks are being used for identical services, i.e., solar energy solutions,”
the court said.

The court further emphasized that these fake websites were taking unfair advantage of Tata’s reputation and deceiving unsuspecting customers.
Since none of the imposter domains appeared before the court, the Delhi High Court ruled in favor of Tata Power Solar and granted a permanent injunction against the defendants.
“A decree of permanent injunction is passed in favour of the plaintiffs and against the defendants,”
the court stated.

The court also ordered the suspension of www.tatapowersolarroof.com and was informed that the other two domains had already been suspended.
