Today, On 27th January, The Delhi High Court dismissed a petition seeking the cancellation of AAP’s registration due to alleged non-disclosure of criminal records by party members. The court found no substantial grounds to support the claims made in the plea. It emphasized the need for concrete evidence in such matters. This ruling highlights the principle of due process in addressing allegations against political entities.
New Delhi: The Delhi High Court declined to consider a plea aimed at revoking the Aam Aadmi Party’s (AAP) registration, which claimed the party failed to disclose the criminal records of itself and its candidates for the upcoming assembly elections.
The petitioner, Ashwin Mudgal, requested a bench consisting of Chief Justice D K Upadhyaya and Justice Tushar Rao Gedela to instruct the Election Commission of India to cancel the party’s registration, arguing that the lack of disclosure violated Supreme Court directives.

The plea stated,
“The Supreme Court mandates the publication of criminal antecedents by candidates and political parties.”
Mudgal’s counsel pointed out that AAP was implicated in the liquor scam and did not disclose its status as an accused in the case.
However, the court noted that the Supreme Court’s directive did not include provisions for de-recognizing a political party. Consequently, the petitioner withdrew the petition but retained the option to approach the Supreme Court.
The issue of criminal records often becomes a important topic during assembly elections, as candidates with criminal backgrounds can influence public trust and perceptions of governance. Electoral reforms in India, such as mandatory affidavits disclosing criminal records, aim to enhance transparency.
