New Delhi: Justice Girish Kathpalia refused Sourav regular bail on November 2 in an alleged APK-enabled cyber-fraud case [Sourav v. State of NCT of Delhi].

The competing submissions

The defence said the complainant’s Rs 6.34 lakh had been repaid and a quashing petition filed. Opposing bail, the prosecution alleged eight other similar FIRs and proceeds of Rs 4–5 crore in this case.

Why settlement did not suffice

In paragraph 7, the Court said criminal courts were “not the forum for recovery of money”. It noted there was no settlement with other victims, adding that such settlement would not itself justify bail.

Citing the alleged offence’s gravity and scale, it dismissed the application. This decides bail, not guilt; charges were yet to be framed.
