NEW DELHI: In a landmark decision the Delhi High Court emphasized the value of personal relationships over legal technicalities, and quashed a case against Arif Khan, who had been accused of eloping with a woman alleged to be a minor in 2015. The couple, sharing the same religious faith, had married according to Muslim rites and ceremonies.

The case came to the fore when Khan was arrested, and it was discovered that his wife was five months pregnant. In a strong affirmation of their union, she refused to consider abortion, stating that the child was a symbol of their marital love. Khan spent nearly three years in prison before being released on bail in April 2018. The couple, reunited, later welcomed another daughter, further solidifying their family unit.
Upon reviewing the details, the Court recognized that while the couple’s marriage might not have initially aligned with legal standards, the enduring support of Khan’s wife, their nearly eight-year marriage, and their two daughters, aged eight and two and a half, were significant factors. The Court’s order highlighted the importance of the family’s future, including the well-being of the children and the wife’s role as a homemaker, in their harmonious life built over nine years.
This ruling by the Delhi High Court underscores the importance of considering the human aspects and the realities of life in legal judgments, especially in cases involving personal relationships and family life. The decision not only liberated Khan from legal charges but also recognized the legitimacy and depth of the couple’s relationship and their commitment to their family.
