Justice Subramonium Prasad prompted the senior counsel representing the suspended legislators to seek guidance on this matter, following remarks from the assembly’s senior lawyer indicating a parallel with the approach taken in the Supreme Court regarding MP Raghav Chadha’s case. Representing the assembly, senior advocate Sudhir Nandrajog stressed that the issue transcends politics, emphasizing its significance in upholding the dignity of the lieutenant governor’s office.
Nandrajog stated,
“I spoke to the speaker. He also suggested the route followed by the Supreme Court in Raghav Chadha’s case. If members were to come and meet the speaker and apologise to the LG, the whole thing could be put through.”
Senior advocate Jayant Mehta, representing the MLAs, expressed readiness to offer apologies to the LG without difficulty. In response, the court requested the petitioners’ counsel to return for the post-lunch session with further instructions.
The seven BJP MLAs-Mohan Singh Bisht, Ajay Mahawar, O P Sharma, Abhay Verma, Anil Bajpai, Jitender Mahajan, and Vijender Gupta-had filed a petition in the high court on Monday, challenging their indefinite suspension from the Assembly for disrupting the Lieutenant Governor’s address. They argued that their suspension until the conclusion of proceedings before the privileges committee violated applicable rules, preventing them from participating in the ongoing budget session.
The BJP MLAs had repeatedly interrupted Lt Governor VK Saxena during his address on February 15, aiming to critique the achievements of the AAP government led by Arvind Kejriwal on various fronts.
