Delhi High Court Halts Proceedings Against Suspended BJP MLAs for Disrupting Lieutenant Governor’s Address

The Delhi High Court has intervened, pausing the proceedings against suspended BJP MLAs who disrupted the Lieutenant Governor’s address. The MLAs, including Mohan Singh Bisht, Ajay Mahawar, O P Sharma, Abhay Verma, Anil Bajpai, Jitender Mahajan, and Vijender Gupta, challenged their indefinite suspension, arguing it violated procedural norms and hindered their participation in the ongoing budget session. The disruptions occurred during Lt Governor VK Saxena’s address on February 15, aimed at scrutinizing the AAP government’s performance under Arvind Kejriwal.

New Delhi: The Delhi High Court has intervened in the case involving seven BJP MLAs who were indefinitely suspended for disrupting Lieutenant Governor V K Saxena’s address during the Budget session. Justice Subramonoium Prasad directed the privileges committee of the Delhi assembly to halt its proceedings against the MLAs while the court hears the matter on merit, emphasizing the importance of fair and impartial adjudication.

Justice Subramonoium Prasad, who was hearing the petitions by the seven opposition legislators, said since the court is hearing the matter on merit, the committee should not continue with the proceedings.

The seven suspended BJP MLAs—Mohan Singh Bisht, Ajay Mahawar, O P Sharma, Abhay Verma, Anil Bajpai, Jitender Mahajan, and Vijender Gupta—petitioned the high court to challenge their suspension from the assembly.

The court expressed concern over the suspension, highlighting the absence of representation for their constituencies in the House due to the MLAs’ suspension.

“Since I have started hearing today, the privileges committee should not continue. All further proceedings must be kept in abeyance,” the judge orally told the senior counsel appearing for the assembly.

Earlier attempts were made to resolve the issue outside of court, as LG Saxena reportedly accepted the MLAs’ apology. However, the court emphasized the need for a comprehensive review of the matter to ensure fairness and justice for all parties involved.
