Justice Gedela emphasized the risks of AI, stating, “AI is a dangerous tool in anybody’s hands…” The court postponed the hearing to February 20, allowing the government to provide a clear response.

NEW DELHI: The Delhi High Court on Wednesday asked a lawyer representing the central government to get proper instructions before replying to a petition against the Chinese AI company DeepSeek.
The case was heard by Chief Justice Devendra Kumar Upadhyay and Justice Tushar Rao Gedela.
During the hearing, the government lawyer said that the issue needed proper attention.
“AI is a dangerous tool in anybody’s hands, whether it is Chinese or American; doesn’t make a difference. It is not that government is unaware of these things, they are very well aware…,”
-Justice Gedela remarked.
The petition against DeepSeek raised concerns about privacy and security since the platform was launched. The court initially asked about the legal process for blocking such websites.
At that point, the government lawyer told the court that the matter was already under consideration. After hearing this, the court said it would close the petition.
However, when the lawyer could not confirm whether the issue was already being considered or if it still needed attention, the court decided to postpone the hearing. This was done to give the government lawyer time to get clear instructions.
When the lawyer for the petitioner argued that the case was directly related to the violation of privacy rights, Justice Gedela responded:
“You are in dark web 97%. What are you saying? You are next generation youngsters. You know more about it than us. You think this data, any data is safe? Are you aware of dark web. Are you aware that 97% of the iceberg is tilted around. Are you aware of that? So therefore they are saying consideration … we are giving them an opportunity, please wait.”

After this discussion, the court scheduled the next hearing for February 20.
Advocates Nihit Dalmia and Bhavna Sharma represented the petitioner, while Advocate Ishkaran Bhandari appeared on behalf of the Union of India.
