The Delhi High Court Today (July 3rd) rejected a plea seeking disqualification of Prime Minister Narendra Modi from contesting elections and said that person who filed the plea appeared to be suffering from mental health issues.
Thank you for reading this post, don't forget to subscribe!NEW DELHI: On Wednesday, the Delhi High Court dismissed a petition seeking the disqualification of Prime Minister Narendra Modi from contesting elections, citing concerns over the mental health of the petitioner, Captain Deepak Kumar. The court suggested that Kumar appeared to be suffering from mental health issues.
A Division Bench consisting of Acting Chief Justice Manmohan and Justice Tushar Rao Gedela directed the local Station House Officer (SHO) and the District Judge to monitor Kumar and, if necessary, use their powers under the Mental Healthcare Act.
This decision came after Kumar accused Prime Minister Modi, Home Minister Amit Shah, and former Civil Aviation Minister (now Minister of Communications) Jyotiraditya Scindia of taking a false oath of allegiance to the Indian Constitution.
Kumar also claimed that Prime Minister Modi, with the assistance of a former Chief Justice of India, was attempting to kill him. The court addressed Kumar directly, inquiring about his well-being.
“Are you well? Your petition is incoherent. It is going from one end of the spectrum to the other. It is going from saying that the plane you were flying crashed to your daughter is missing to former CJI trying to kill you. Are you well? No human being can understand the petition. It makes no sense, and the single-judge is right in saying that it is replete with unsubstantiated allegations,”

The Bench concluded that Kumar’s allegations were a figment of his imagination and lacked any material substance. Describing the claims as preposterous, the court dismissed the appeal and advised the authorities to keep a close watch on Kumar.
Previously, Kumar had approached a single-judge of the High Court, alleging that Prime Minister Modi had submitted a false oath of allegiance to the Constitution of India. The petition stated,
“The Candidate for Varanasi constituency for the 2024 general elections Narender Modi had submitted before the returning officer a false oath or affirmation to bear true faith and allegiance to the Constitution of India.”
Kumar further accused Prime Minister Modi of hatching a conspiracy and being involved in an act of terrorism, claiming that Modi tried to kill him by crashing a plane he was piloting. He demanded an investigation into Modi’s alleged false oath, suggesting that if the accusations were proven true, Modi should be barred from holding any public office.
The single-judge of the High Court had already rejected this plea on May 30, ruling it as mala fide.
This case highlights the court’s responsibility to balance serious allegations against the mental health of petitioners, ensuring justice while addressing potential health concerns.
