Calcutta High Court Lifts Stay on Appointment of 29 Civil Judges in West Bengal

With this judgment, the earlier stay on judicial appointments has been removed. The recruitment process for these 29 civil judges in West Bengal can now continue without further delays.

Calcutta: The Calcutta High Court has removed an earlier ban on appointing 29 civil judges who cleared the West Bengal Judicial Services Exam in 2022.

This decision, reported by the Times of India, was given by Justice Arindam Mukherjee on Tuesday.

Justice Mukherjee dismissed multiple petitions that questioned how the exam was conducted. The preliminary exam for the 2022 batch took place in March 2023, followed by the mains exam in May 2023, and interviews in April 2024.

Even though the Public Service Commission (PSC) announced the final selection list in May 2024, the candidates were still waiting for their official appointment as civil judges.

Two Result Lists Created – Regular and Provisional

The West Bengal Public Service Commission published two different lists of selected candidates:

  1. Regular List – Candidates in this list were directly appointed.
  2. Provisional List – Candidates in this list were given priority for future vacancies.

However, some candidates from the provisional list went to the High Court, asking for a single, unified list for appointments. There was also a separate legal challenge alleging mistakes in how the reservation policy was applied.

Justice Mukherjee has ruled that “there was no obstacle to publishing two lists.”

With this judgment, the earlier stay on judicial appointments has been removed. The recruitment process for these 29 civil judges in West Bengal can now continue without further delays.
