Mumbai: In a major legal victory for actress Rupali Ganguly, the Bombay High Court has granted ad interim relief in a defamation suit filed against Esha Verma and others. The case, which has captured public attention, involves allegations that Verma, the daughter of Ganguly’s husband from his first marriage, has been spreading defamatory content aimed at damaging the actress’s reputation. The court order prohibits Verma and other related parties from posting, sharing, or hosting any defamatory content on digital platforms.

The lawsuit revolves around claims that Esha Verma has conducted a sustained campaign to tarnish Ganguly’s image through a series of social media posts, media interviews, and articles. The defamation includes unverified allegations and malicious remarks that have been shared widely, causing significant harm to the actress’s personal and professional life.

During the hearing, Justice Arif S. Doctor reviewed the evidence presented by Ganguly’s counsel, Advocate Sana Raees Khan, which included a compilation of the defamatory content. The court acknowledged the prima facie defamatory nature of the content, noting its malicious intent, particularly given Verma’s absence from court despite being served notices. One of the allegations against Ganguly was that she interfered in her husband’s previous marriage and abused Verma and her mother emotionally and verbally—claims the court deemed baseless and harmful to Ganguly’s reputation.

The court granted a prohibitory injunction, which includes the following key provisions:

  • Esha Verma and her representatives are prohibited from publishing, posting, or distributing any defamatory material against Ganguly on any platform, including social media and digital media.
  • Third-party platforms, such as social media intermediaries, are barred from hosting, sharing, or promoting any defamatory content related to Ganguly.
  • The court has also restrained anyone directly or indirectly involved in the defamatory campaign from further spreading harmful material.

The court emphasized the urgency of the case, acknowledging the ongoing damage to Ganguly’s career and personal life. It recognized the need to act swiftly to prevent further harm.

This decision underscores the increasing significance of legal recourse for defamation in the digital age, where unverified claims can spread quickly and widely on social media platforms. Advocate Sana Raees Khan argued that this defamation campaign not only undermines Ganguly’s reputation but also highlights the dangers of unchecked online harassment.

The case is scheduled for a further hearing on February 17, 2025. The court has mandated that a copy of the order be served to the defendants. Justice Doctor also warned that failure to appear at the next hearing could result in the court proceeding without them.
