NEW DELHI: The Delhi High Court today deferred hearing and is scheduled to hear on December 9 the plea submitted by opposition leaders of the city. The plea seeks a directive to ensure the Comptroller and Auditor General (CAG) reports concerning liquor duty, pollution, and finance are tabled before the Delhi Legislative Assembly.

Justice Sanjeev Narula postponed the hearing during Monday’s session, observing that the case’s pleadings were not yet finalized.

The petitioners’ counsel highlighted the urgency of the matter, emphasizing that the current Assembly session was set to end on December 4.

On the other hand, the Delhi government’s counsel countered this by stating-

“This is not the last session.”

Background

The Delhi High Court on Friday (29 Nov) expedited the hearing of a similar plea filed by several BJP MLAs. This plea sought the immediate tabling of 12 pending CAG reports related to liquor duty, pollution, and finance before the Delhi Legislative Assembly.

Justice Narula advanced the hearing date from December 9 to December 2, responding to an early hearing application submitted by the petitioners.

The plea was filed by Leader of Opposition Vijender Gupta alongside BJP MLAs Mohan Singh Bisht, Om Prakash Sharma, Ajay Kumar Mahawar, Abhay Verma, Anil Kumar Bajpai, and Jitendra Mahajan. The petitioners argued that withholding the reports compromised democratic accountability.

Advocate Anil Soni, representing the petitioners, stressed the urgency, stating that the Winter Session of the Delhi Assembly was already underway and scheduled to conclude on December 3. The plea also pointed out that CAG reports for financial years 2017-18 to 2021-22 were still pending with the Chief Minister.

This case underscores the ongoing tussle over transparency and accountability in Delhi’s legislative processes, with the opposition asserting their concerns about delayed action on critical reports.
