[Badlapur Assault Case] Parents of Akshay Shinde, Who Killed in Alleged Police Encounter, Seek to Close Case in Bombay High Court

On Thursday, Akshay Shinde’s parents, who had earlier filed a petition claiming that their son was killed in a fake police encounter, appeared before a division bench of Justices Revati Mohite Dere and Neela Gokhale.

Mumbai, February 6– The parents of Akshay Shinde, a Badlapur school attendant accused of sexually assaulting two minor girls and later killed in an alleged police encounter, have informed the Bombay High Court that they no longer wish to continue their legal battle over his death.

On Thursday, Akshay Shinde’s parents, who had earlier filed a petition claiming that their son was killed in a fake police encounter, appeared before a division bench of Justices Revati Mohite Dere and Neela Gokhale.

They told the court they were no longer interested in pursuing the case and requested that it be closed.

The couple clarified that their decision was made voluntarily and that they were not facing any external pressure.

Akshay Shinde, 24, worked as an attendant at a school in Badlapur town, Thane district. He was accused of sexually assaulting two minor girls inside the school toilet in 2023. While being transported from Navi Mumbai’s Taloja prison to Thane for questioning, he was killed in an alleged police encounter.

A magisterial inquiry into Shinde’s death was conducted, and the findings were submitted to the Bombay High Court last month in a sealed report. The inquiry held five police officers responsible for his death:

  • Senior Inspector Sanjay Shinde (Thane Crime Branch)
  • Assistant Inspector Nilesh More
  • Head Constables Abhijeet More and Harish Tawade
  • Police Van Driver Satish Khatal

Magistrate Ashok Shengde, in his report, raised doubts about the police officers’ claims of acting in self-defense.

The report noted that “the contention raised by the police personnel of right to private or self-defence comes under a shadow of suspicion” due to the evidence and circumstances.

During Thursday’s hearing, Advocate Amit Desai, representing the Maharashtra government, requested the Bombay High Court to grant access to certain materials used in the magisterial inquiry.

He informed the court that these materials were not with the police, as the magistrate had recorded witness statements separately. Desai argued that the police are still investigating the matter and need access to these materials for further analysis.

The Bombay High Court has scheduled the next hearing for Friday.
