BREAKING || Arvind Kejriwal Issuing Directions from Custody | Delhi HC asks ED to Give Trial Court Status Report

NEW DELHI: The Delhi High Court issued a directive Today, instructing the Enforcement Directorate (ED) to submit a status report to the trial court regarding Arvind Kejriwal’s actions as Delhi Chief Minister while under the agency’s custody.

A Division Bench comprising Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora delivered the order in response to a public interest litigation (PIL) seeking measures to prevent Kejriwal from issuing directives while in custody.

The Court advised the petitioner that if any violation occurred, it could be brought to the ED’s attention, which would then inform the trial judge. Initially suggesting treating the petition as a representation before eventually directing the submission of a status report, the plea was accordingly disposed of.

The PIL was lodged by Surjit Singh Yadav, a self-proclaimed farmer and activist.

Arvind Kejriwal was apprehended by the Enforcement Directorate (ED) on March 21 in connection with the alleged Delhi Excise Policy case.

Subsequently, on March 25, Delhi Minister Atishi asserted that Kejriwal forwarded a document from ED custody with instructions to address public concerns regarding water supply and sewage.

Moreover, on March 26, Kejriwal purportedly issued additional directives, instructing Health Minister Saurabh Bharadwaj to ensure the availability of free medications and tests in Delhi’s government hospitals and community clinics.

The ED acknowledged Kejriwal’s directives and pledged to investigate whether they adhered to the court’s orders.

Yadav’s petition sought directions to the ED to withhold the provision of a typist, computer, or printer to Kejriwal during his incarceration. Additionally, Yadav demanded an inquiry into how Kejriwal’s orders were being relayed to ministers like Atishi.

Notably, Yadav previously filed a separate PIL aiming to remove Kejriwal from the Chief Minister’s position, which the High Court dismissed on March 28.

Earlier, Yadav lodged a PIL urging the Home Ministry and the Election Commission to take action against Kejriwal, Rahul Gandhi, and Akhilesh Yadav for their alleged defamatory remarks against the government. This petition, too, was rejected by the High Court on March 20.
