Allahabad High Court Bar Association Suspends Strike Over Judge Yashwant Varma Transfer Till Inquiry Ends

Allahabad High Court Bar Association Suspends Strike Over Judge Yashwant Varma Transfer Till Inquiry Ends

UTTAR PRADESH: The Allahabad High Court Bar Association (HCBA) has decided to suspend its strike temporarily. This decision came on Saturday, March 29, after the association agreed to wait for the result of an internal inquiry against Justice Yashwant Varma, who was recently transferred from the Delhi High Court to the Allahabad High Court.

The lawyers were protesting against this transfer, especially after some unaccounted cash was found at Justice Varma’s house in Delhi during a fire incident on March 14.

As per the official resolution passed on March 29 by the HCBA:

“The direction of the protest was altered, and a new strategy was adopted. It was unanimously decided to suspend the ongoing judicial work boycott by the High Court Bar Association until the inquiry report on Justice Yashwant Varma is received. Further decisions will be made based on the report. Judicial work will resume as usual from Tuesday, April 1, 2025.”

This means that normal court work will restart from April 1, but the Bar Association has made it clear that their final decision will depend on the findings of the inquiry committee.

Along with this, the association also passed some more proposals:

“A proposal was passed to establish a Photo Identification Center to benefit litigants and advocates, ensuring smoother judicial proceedings.”

They also decided to hold a major event to gather national support:

“It was also unanimously decided to hold a national-level press conference at the High Court Bar Association in Prayagraj on April 26-27, 2025, to strengthen the movement and garner support from High Court Bar Associations across the country.”

The controversy started when a fire broke out at the house of Justice Yashwant Varma in Delhi on March 14. Firefighters, while controlling the fire, found unaccounted cash inside the house. At that time, Justice Varma and his wife were not in Delhi, as they were travelling in Madhya Pradesh. Only his daughter and elderly mother were at home when the incident happened.

This led to a huge public and legal uproar, including some people demanding that the judge should be impeached.

To handle this serious matter, on March 21, Chief Justice of India Sanjiv Khanna ordered an in-house inquiry and formed a committee of three High Court judges to look into the issue.

In the meantime, the Supreme Court released both the report by the Chief Justice of the Delhi High Court and Justice Varma’s written response on the incident.

Despite protests, the Supreme Court Collegium moved forward with its decision to transfer Justice Varma from the Delhi High Court to his original High Court in Allahabad.

This led the Allahabad HCBA to declare an indefinite strike as a mark of protest. However, the situation changed quickly. On March 28, the Central Government officially approved the transfer of Justice Varma.

On the same day, the Supreme Court directed the Chief Justice of the Allahabad High Court to not assign any judicial work to Justice Yashwant Varma for the time being.

After all these developments, the Allahabad HCBA decided to pause their protest, but only until the inquiry report is submitted. They are waiting to see the outcome of the investigation.

Additionally, the lawyers have made it clear that:

They will not attend the oath-taking ceremony of Justice Yashwant Varma at the Allahabad High Court.
